Terms of Service

Welcome to Tune. These Terms of Service ("Terms") govern your use of tunehealth.co (the "Site") and your purchase of products from Tune Hydration LLC, doing business as Tune Health ("Tune," "we," "us"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Eligibility

You must be at least 18 years old to purchase products from the Site. By placing an order, you confirm that you are 18 or older.

2. Our Products Are Not Medical Advice

Tune products are dietary supplements. These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

Nothing on the Site, in our emails, or in our content is medical advice or a substitute for care from a qualified healthcare professional. Always consult your physician before starting any supplement, especially if you are pregnant, nursing, taking medication, or have a medical condition. Do not use our products if you are pregnant or nursing unless directed by your physician. Stop use and consult a doctor if you experience an adverse reaction.

Individual results vary. Testimonials on the Site reflect individual experiences and are not a promise of results.

3. Product Information

We work hard to describe our products, ingredients, and labels accurately, but we don't warrant that all descriptions, images, or other content on the Site are complete or error-free. The label on the product you receive is the authoritative source for ingredients, allergens, and directions. Always read the label before use.

4. Orders, Pricing, and Payment

All prices are in US dollars and exclude taxes and shipping unless stated otherwise. We may change prices at any time, but changes won't affect orders already placed. We reserve the right to refuse or cancel any order, including orders we suspect are fraudulent, placed by resellers, or affected by a pricing or listing error. If we cancel an order after payment, we'll refund you in full.

You represent that the payment information you provide is accurate and that you're authorized to use it.

5. Subscriptions

If you purchase a subscription, you authorize us to charge your payment method on a recurring basis at the frequency you select at checkout, at the subscription price shown at checkout, until you cancel.

• Billing. Your payment method is charged automatically before each shipment at your selected frequency. The subscription discount applies for as long as your subscription is active.
• Canceling. You can skip, pause, reschedule, or cancel anytime from your account page, or by emailing hello@tunehealth.co. Cancellation takes effect immediately for any orders not yet billed. To avoid being charged for an upcoming shipment, cancel before the next billing date shown in your account.
• Changes. If we change your subscription price, we'll notify you by email at least 30 days before the new price takes effect, and you can cancel before it does.
• Guarantee. The Tune Guarantee in our Return and Refund Policy applies to your first subscription shipment.

6. Shipping and Risk of Loss

Shipping timelines shown at checkout are estimates. Title and risk of loss pass to you upon our delivery of the products to the carrier. If your order arrives damaged or doesn't arrive, contact us at hello@tunehealth.co and we'll make it right per our Return and Refund Policy.

7. Returns and Refunds

Returns and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms.

8. Intellectual Property

The Site and everything on it, including the Tune name, logos, product names, formulas, packaging, photos, videos, and copy, are owned by Tune or our licensors and protected by intellectual property laws. You may not copy, reproduce, or use them without our written permission, except as needed to browse the Site and place orders.

9. Content You Share With Us

If you submit, post, or tag content involving Tune or our products, including reviews, photos, videos, social posts, and feedback ("Your Content"), you grant Tune a worldwide, royalty-free, perpetual, transferable license to use, reproduce, modify, display, and distribute Your Content in connection with our business, including marketing, in any media. You confirm you own Your Content or have the rights to grant this license, and that it doesn't violate anyone else's rights.

We may remove or decline to use any content at our discretion. Feedback and suggestions you send us may be used freely without obligation to you.

10. Prohibited Uses

You agree not to use the Site to violate any law, infringe anyone's rights, transmit malicious code, scrape or harvest data, interfere with the Site's operation, place fraudulent orders, or resell our products without our written authorization.

11. Third-Party Links and Services

The Site may link to third-party sites or services we don't control. We're not responsible for their content or practices, and linking doesn't imply endorsement.

12. Disclaimer of Warranties

Except as expressly stated in these Terms or our Return and Refund Policy, the Site and our products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Site will be uninterrupted or error-free.

Some jurisdictions don't allow disclaimers of implied warranties, so some of the above may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, Tune and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the Site, our products, or these Terms. Our total liability for any claim will not exceed the amount you paid us for products in the twelve (12) months before the claim arose.

Some jurisdictions don't allow these limitations, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

14. Indemnification

You agree to indemnify and hold Tune harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your violation of these Terms, or your violation of any law or third-party right.

15. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

• Informal resolution first. Before filing any claim, you agree to contact us at hello@tunehealth.co and give us 30 days to try to resolve the dispute informally.
• Binding arbitration. Any dispute arising out of or relating to these Terms, the Site, or our products that isn't resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this agreement to arbitrate.
• Class action waiver. You and Tune each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding. Disputes will be resolved on an individual basis only.
• Small claims carve-out. Either party may bring an individual claim in small claims court instead of arbitration.
• Opt-out. You may opt out of this arbitration agreement by emailing hello@tunehealth.co within 30 days of your first purchase with your name, order number, and a statement that you opt out of arbitration. Opting out won't affect any other part of these Terms.

16. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles, except that the Federal Arbitration Act governs Section 15. For any dispute not subject to arbitration, you and Tune consent to the exclusive jurisdiction of the state and federal courts located in Denver, Colorado.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a revised "Last updated" date. Material changes to subscription terms will be communicated per Section 5. Your continued use of the Site after changes take effect constitutes acceptance.

18. Severability and Miscellaneous

If any provision of these Terms is found unenforceable, the rest remains in effect, except that if the class action waiver in Section 15 is found unenforceable, the entire arbitration section is void. These Terms, together with our Return and Refund Policy and Privacy Policy, are the entire agreement between you and Tune regarding the Site and our products. Our failure to enforce any provision isn't a waiver.
